1. Policy Statement
Quality Waste is committed to complying with the Immigration, Asylum and Nationality Act 2006 and all related UK legislation. We have a legal obligation to ensure that all employees have the right to work in the UK.
This policy sets out the procedures to verify the right to work of all staff, contractors, and temporary workers, ensuring that Quality Waste operates legally and responsibly.
2. Scope
This policy applies to:
- All employees (permanent, temporary, and agency staff).
- Contractors and subcontractors working for Quality Waste.
- Any new hires during the recruitment process.
3. Procedures for Checking Right to Work
3.1 Document Verification
- All candidates must provide original documents from the Home Office’s list of acceptable documents before starting work.
- Acceptable documents include:
- Valid UK passport or British/Irish citizenship documents.
- Biometric Residence Permit or Home Office visa.
- Birth/adoption certificate in combination with official photo ID.
- Home Office online status verification (share code).
3.2 Document Checks
- Checks must be conducted in the presence of the employee or candidate (in person or via live video where applicable).
- HR or the recruiting manager will verify:
- Authenticity of documents.
- Expiry dates and any work restrictions.
- Consistency of photo, name, and date of birth.
- Copies of documents or online check results will be securely stored.
3.3 Record Keeping
- Copies of documents and a record of the check, including date and person carrying out the check, will be retained securely for the duration of employment and for at least two years after employment ends.
3.4 Follow-Up Checks
- For employees with time-limited visas or work permissions, HR will carry out follow-up checks prior to expiry.
- Employees with indefinite leave, settled status, or British/Irish citizenship do not require further checks.
4. Responsibilities
Directors & Senior Management
- Ensure compliance with this policy and UK immigration laws.
HR & Recruiting Managers
- Conduct document checks according to this policy.
- Maintain secure records and conduct follow-up checks as required.
Employees
- Provide valid and genuine documentation for verification.
- Inform HR of any change in immigration or work status.
5. Reporting & Compliance
- Any suspected fraudulent documents or breaches of right-to-work legislation must be reported immediately to HR and senior management.
- Quality Waste will take all appropriate action to investigate and resolve potential breaches.
6. Training
- All HR staff and recruiting managers will receive training on right-to-work checks and identification of valid documents.
- Training will be updated periodically to reflect changes in legislation.
7. Approval
This Right to Work Policy has been approved by the Board of Directors of Quality Waste.
