A CLEAR GUIDE FOR BUSINESSES

Business Waste Duty of Care

Know who is taking your waste, where it is going and what paperwork to keep. A useful starting point for safer business recycling.

Your Waste Is Still Your Responsibility

A business clear-out should make life easier. But paying someone to take waste away does not, by itself, mean your duty of care is finished. You need to take reasonable steps to keep the waste safe and make sure it reaches people authorised to handle it.

That applies to everyday office rubbish as well as WEEE recycling, waste oil, paint, chemicals and unwanted stock. A small business has responsibilities too: it is not only a rule for factories or large waste producers.

Check Who Is Collecting It

Ask for the collector’s legal business name and waste carrier registration, then check the relevant regulator’s public register. A registration number on a van or website is a starting point, not the whole check. Confirm that the name matches and the registration covers the activity.

Ask where the waste will go and check the receiving site has the appropriate permit or exemption for the waste and activity. Carrier registration is not permission to operate a treatment site. Keep a record of your checks and investigate anything that does not add up.

Describe What You Are Handing Over

“Business waste” is often too vague. The description needs to help the next person handle the waste safely. Include what it is, how it arose, relevant composition, the correct waste code and the amount and containment required by the applicable paperwork.

For example, computer equipment, mixed batteries and partly full paint tins should not all be described as ordinary office rubbish. Chemical labels, safety data sheets and photographs can help a contractor understand what you have; a safety data sheet alone does not determine a waste’s classification.

Keep Waste Safe Before Collection

Use suitable containers, keep lids secure where needed and prevent leaks, litter and access by unauthorised people. Separate waste streams that must not be mixed. Batteries, liquids and chemicals need storage arrangements suited to their particular risks.

Ask your contractor for help when you are unsure. Do not put damaged lithium batteries into a general WEEE bin or mix chemical leftovers simply to save space.

Get the Right Collection Paperwork

For non-hazardous waste transfers in England and Wales, you need a waste transfer note or another document containing the required information. Both parties must complete the relevant details and sign it. Keep the records for at least two years.

A season ticket can cover qualifying repeat transfers for up to a year, with a separate record of the collections. It needs to fit the actual arrangement; it is not a blanket note for any waste collected during that year.

Hazardous waste in England normally needs a consignment note, rather than an ordinary transfer note. Producers and holders must keep the required hazardous waste register for three years, including consignment notes and consignee returns. Check the rules for your nation: Scotland uses special waste arrangements, and Welsh and Northern Irish requirements differ.

Destruction Certificates Have a Different Job

A Certificate of Destruction is included with Quality Waste’s paper, product and stock destruction services. Data-bearing media are shredded as standard, with a Certificate of Data Destruction included. These certificates support your destruction records; they do not replace statutory waste movement paperwork.

A Useful Routine for Your Team

Keep your collector checks, collection paperwork and any relevant destruction certificates in one place. Review them when you change contractor, introduce a new waste stream or change how waste is stored. An invoice proves a payment; it may not contain all the information needed for your waste records.
